    Question Eviction of Son Who is on Lease

    My question involves an eviction in the state of: California

    When my son turned 18, my apartment management required that his name be added to the lease. Since that time, he has he started using drugs and alcohol again lost his job and stopped going to college so I asked him to leave..He didn't so then I told him he had 30 days to get out.Well he called the managers and the police and both told him he had rights and couldn't be kicked out or locked out.

    Since then I have pleaded with the management to take him off the lease to no avail and of course he refuses to take himself off the lease or move..He has since become violent with my younger son and comes and goes when ever he pleases sometimes not coming home at all.

    So I have the police telling me I cant kick or lock him out and that I need to try and evict him and I have the management telling me I cant or I have to go as well since we both are on the lease.

    How can I get him out of my apartment?

    You are in somewhat of a bind obviously.

    I know that if your son was willing to leave that the management company could have him removed from the lease and have you sign another lease under just your name.

    AND, if they wanted to be real jerks and knew about his drug situation, they could evict BOTH of you.

    For starters, I would definitely begin by calling the police any time he gets violent and/or does drugs and you know he is doing it.

    However, if it happens in your apartment, they could still evict you personally.

    Wow, you have me stumped. As unpleasant as it seems, you may have to have him arrested when you know he is doing something illegal outside of the property. That is the only way I know you are safe from eviction .

    Sorry for your situation.

    I would also investigate low-cost legal services.

    When your lease ends, you can decline to renew with him as a cotenant.

    If you're in fear for your personal safety, you can seek a protective order.
