    Default Charged for fees not listed in lease

    We bought a house in March and gave our 30 day notice in March as well. We have moved out before the 30 days were up, but filled out the Notice to Vacate. We are being charged an abandonment fee, and Insiffcient notice fee.

    My question is can the landlord do that. Although we moved well before the 30 days waas up, we still gave notice, and the abandonment fee isn't listed in our lease.

    Did you have a lease? If so, when did the lease term expire?

    the lease expires 06/2006. In the lease Break Addendum it says that you willbe charged for 2 months rent max. Which they are not evening charging me for.

    So these fees which the landlord is attempting to charge, and which are not in the lease, along with the rent charge from your date of notice foreward, are greater than the two month maximum charge permitted by the lease? If that's the case, your landlord does not appear to have a basis to charge the greater amounts.

    thanks I have placed a call to the Mgr who still has not called me back. A new company bought the property, but I am still under the lease of the old company.

    I have not been given any notice of additional move out fees either verbal or in writing. But from what I know the fees are listed in the new company's lease. Which I did not sign.

    We gave notice that we were intending to vacate 4-3-06 but moved out on 3-4-06 instead, and there is a charge for insufficient notice.


    Can we be charged for insuff. notice becuase we moved out before the 30 days even through we gave written notice.

    I am not sure who I would call in my state to find out. It's Village Green Apartments.

    You're liable for rent through the end of your notice period. Is there a provision in the lease requiring you to notify the landlord when you vacate, and is this an attempt to impose a fee because you failed to do so? Because normally you can vacate whenever you want, as long as you pay your rent as required by the lease.

    We are not being charged for rent at all, which I know that we owe and agree upon with the company. They are charging us for abandonment, and insuff. notice although we gave then a written notice, and no property was left behind.

    These two fees that they are charging us for are in the NEW lease, for the new company that just took over.

    But we have a lease with the original company, and their provisions, state that you are responsible for up to two months of rent only.

    There is a provision in the lease that requires notice, but it does not indicate a penalty for no notice. The bill says that no notification was given, but I have a copy of the notice to vacate, signed by the mgr now I am not sure how they consider that insuff. notice.
