    Default Bankruptcy Dismissed Because Lawyer Did Not File All Documents

    My question involves bankruptcy in the state of: Florida.

    I just received a letter that my Chapter 7 bankruptcy case was dismissed with prejudice because all of the required forms were not submitted. I rec'd a letter 8/17 saying that certain forms were missing and when I spoke to my lawyer on 08/19 they assured me that everything was submitted.

    Now my case has been dismissed with prejudice because my lawyer lied to me.

    What can I do? Is she able to re-open it because it was her error? Not that she will necessarily admit that. What about the with prejudice part? It says I have to wait 180 days to re-file. Can that be changed to without prejudice because my lawyer's incompetent?

    I am so frustrated. I don't know what to do at this point - haven't spoken to her yet because it's the weekend. I want to know what my options are before she gives me some ridiculous story.

    Talk to your lawyer, or a different one. You will probably have to start over.
