    Default Lease Without Moving in

    My question involves landlord-tenant law in the State of: Florida.

    I overnighted a bunch of lease documents to a landlord in Florida. Over the weekend, some things have gone bad and I need to cancel the lease. I called FedEx to reverse the delivery, but they cannot guarantee it. I called the landlord and she said she would return it if delivered. I want to believe her, but I don't know her. I have not moved in to the unit and my scheduled move in date was later on next week. However, the documents are signed and I'm wondering if I'm at her mercy? I've already told her I probably won't be able to pay. Do you think she'd hold me to the lease if received? I've told her to return the package and she agreed without objection, but I have nothing in writing. Am I screwed?

    We have no idea if the landlord would reneg on her promise to return the package if delivered. We cannot predict if she will change her mind and hold you to the lease.

    Rather than panic, you might consider just waiting to see what she'll do. Generally, people try to do the right thing.
