    Question Notice to Evict, Payments Are Current

    My question involves an eviction in the state of: NY

    We are currently renting a home in Wellsville, NY that will turn into a land contract agreement in January (when the final down payment of $4000 is paid). The lease agreement we signed says that either party can terminate the agreement at any time.

    The owners, due to the first-time homebuyers program, want someone else in here due to the fact that they can the money from that immediately, rather than wait until January for us, as planned.

    They served us w/ 30 day notice of termination papers yesterday, despite the fact that are payments are current. Anything we can do???

    In view of the lease clause that says either party may terminate the agreement at any time, and the fact that they've given proper written notice?

    Probably not. You might have the lease looked at by an attorney in your area, but I wouldn't expect him to find a loophole for you.
