My question involves a child custody case from the State of: California
i want to move out of state (Ca) i have sole custody & he has visitation at his brothers here in Ca,which he has never used. he hasnt seen the kids in 6yrs & has had no other contact w/ them for around 4yrs (not a letter,money,etc). there is no child support order either. we were living in Az for that 4yrs due to my current husband being in the air national guard. he had no problems with us moving there but now my husband is being sent to Ms for schooling in 3wks and we want to go with him, understandably.
there is nothing in my divorce papers that states i can't leave the state w/ them or that i have to notify the court when moving. it says HE cant leave the state w/ them though. it doesnt say anything about me giving him a notice that im moving,my papers are pretty cut and dry really.
my lawyer that helped me w/ my divorce said not to worry about him because this wont interfere w/ his visitation since he hasnt exercised it at all yet. my x lives in Mo by the way. im writing because i have bad anxiety issues due to his & his girlfriends constant threats during our divorce. my daughter and i both had to seek counseling due to his abuse,she is better now but wants nothing to do with him because he puts guilt trips on her and makes her feel bad. our son has never wanted anything to do with him. do i need to file a move away paper thing to leave or because theres nothing in my custody that prevents me from leaving can i just go?
All of the info on the net is just confusing me,please help. If more info is needed please ask.
