    Question Roommate Making It Difficult to Show Room or Vacate

    My question involves landlord-tenant law in the State of: California


    Hi,

    I've got a roommate that was the previous head of household on the house which is s 5br 3b and we had found out that he was screwing people for rent and not paying the utilities on time, so we asked him to leave, he gave some fight to it and claimed he would have us kicked out instead however next day he gave the landlord his 30 days notice once the landlord showed up to the house the very next day the confronation occured.

    Since then he has made no attempt in helping us fill the room and letting us show it, keeping the room locked and will not return to the house since staying at a friends house since he gave his notice. Now the issue is its close to the end of the lease and I know he has the right to hold the room till the end of the lease and what not and we gave him a notice that we will be cleaning the garage out of courtesy and if there is anything out there we will make sure to take care of it nicely and place it aside or in the front room where currently his other items remain. He has spoken with the landlord about us moving his items around and the landlord wants nothing to do with the issue however he is threatening legal issues based on tenant rights about us moving his items around in a common area of the house, is it possible for him to do anything about this or is it more him just in attempt to continue making it hard on everyone for his move out? Any advice will be greatly appreciated

    It's not illegal for you to move things around in a common area, so long as you're not doing so to damage it. You have every right to clean up common areas and get stuff out of the way.

    He sounds like a real prize - one you'll be well rid of once he's gone.

    Didn't think so, he came back last night and was all mad because we moved his items from the garage to the living room and claiming he is going to file an unlawful detainer because one of the newer roommates are storing some items in the garage until they are able to move in after one of the other people leave. The landlord was aware of this and had no problem with it since no one is physically moving in and no money was given for rent or otherwise. Guy is just a complete tool

    Which I might add he's done these things before with previous roommates and allowed them to store items in the garage so he's just trying to be as much of a pain as possible
