    Default Tenant Asks for Rent Cut Because of No A/C for 2 Days

    My question involves landlord-tenant law in the State of: Louisiana

    Our tenant complained that A/C is not working two days ago. We acted on it immediately, called home warranty company. Technician can to check yesterday, could not repair, came today went back with more work. It might fixed by tomorrow.

    At the same time, she lost keys and asked us to get them replaced. We did at our cost.

    Today, tenant asked for discount in rent check because it was too hot. It has not been over 80 in the past few days.
    What should I do?

    Does the lease say that the air conditioner will always be 100% functional, and if it's not, there will be a rent reduction? Probably not, hm?

    Under the implied warranty of habitability, it is incumbent upon the landlord, when advised of the need of repairs, to make arrangements for the repairs to be down within a reasonable time frame, particularly if the failure to do so would result in the apartment becoming uninhabitable.

    It appears to me that you have acted promptly and now are simply at the mercy of whatever repairs need to be done. She has been only mildly inconvenienced for a couple of days, it did not significantly impact the habitability of the unit. You have no obligation to reduce her rent.

    What does your lease say about A/C?

    Unless your lease compels something different, and I doubt it, I personally would apologize, tell her that things break at times, and that you don't give rent abatements over routine maintenance issues.

    I suspect if you don't you'll be asked for a rent break every time a toilet is plugged or a sink drain gets sluggish.
