My question involves labor and employment law for the state of: New Mexico
I was fired from Wal-Mart for misconduct regarding the handling of money.
This is what happened, I was working in customer service, I was really busy assisting customers, and an accounting agent, who we'll call "Peggy" brought me a loan for my register for $2000. She placed the money on the top of my register, but underneath the counter where it couldn't be seen. I had a line with about forty customers in it, was working busily, and had totally forgotten about the money. The proper policy is for her to use her key, to open my register, and place the money inside of it.
That night, my register was reported short $2000. Every time you are short $100 apparently you get reported to the District Manager. I got reported 20 times.
The money was found two days later, after I was already reported short, after they had reviewed the surveillance tapes, The tapes showed that I hadn't taken any money. The money was in the exact same place where it was left.
I had two previous writeups for horseplay, nothing serious. This was supposed to be my final warning. I had no previous issues with money, no writeups for money, and no register shortages in my year and a half of employment.
The accounting agent was written up. I was fired. Since then, I have been denied jobs because of that issue, and it's extremely embarrassing for me to explain to a prospective employer what happened, and even worse when they say they'll call me, and never call. I was denied a job as a detention officer, a job that makes $40,000 a year not counting mandatory overtime, as well as a job at an RV dealership, which salaries at $100,000 a year. Not bad for a 20 year old kid out of high school a couple years. But I didn't get those jobs, because of this issue. Do I have a case against them? An anti Wal-Mart advocate said that I should fight them on it, and clear it up in court, and that I'm entitled to a settlement regarding that. What do you think my chances are of succeeding in that regard?
