    Default Canadian Divorcing American

    Hi, I'm wondering how i go about getting a divorce with my husband who lives in Florida, I live in Canada. I am not in the states and he can't get into Canada. Also, when we got married, i was there just as a visitor, no visa's or nothing and it was less than three months of being there. Is our marriage even real, does it exist because we just did it through the courts. Someone please help me

    Given that marriage is a civil contract, it can be handily argued that your marriage is more real for having gone in front of a judge rather than the "traditional" church foofooraw.

    Yes, it's real. You got a marriage license, had the marriage solemnized by one invested with the authority to do so, and that's that. So now you have to have a real divorce.

    If you've been back in Canada for at least a year, you may apply for a divorce in your city of residence, per Canada's Divorce Act.

    You'll need to consult with a divorce attorney in your Province to get started.
