    Post On Informal Probation and Was Just Arrested

    My question involves criminal law for the state of: CA
    I am currently on informal probation for a dui i got in 08. Last week I was arreted for a felony possesion charge (Meth) and a missdeameanor charge for pharaphanelia (pipe). I was released in the morning on my own recongnizence or something like that. When I go to court am I looking at time? Should I get a lawyer? Since my probation was from a dui are these new charges consider a violation please help and thank you so much.

    Most likely. Was that part of what your original sentence was, had you not been given probation?

    Should I get a lawyer?
    Heavens yes. While you certainly have the Constitutional right to represent yourself in court, I'm firmly in Mark Twain's camp on the subject - he who represents himself has a fool for a client. When you retain counsel, you're not just paying for the attorney's knowledge of law and skill at persuasive arguing, you're paying for his or her knowledge of the local courts and the experience has with the various judges and other attorneys.

    That's often much more valuable than the knowledge of the law.

    Absolutely. I would reckon your probation terms include that you keep your nose COMPLETELY clean - avoid all brushes with the law, not just DUIs.

    You were arrested once before for DUI- driving under the influence of drugs/alcohol. The judge will see your being arrested for meth and the pipe as just an extension of your substance abuse problem. So the short answer is yes, you are looking at time, yes, you should get a lawyer, and yes, the new charges are a violation of your original sentencing. Prepare for some time in the grey bar hotel, it's seems as if you have made the reservation.
