    Default Extension of B1

    I am on B1 with 3 month stay upto 30 sep ..I am a doctor doing clinical training which has been extended for another 3 months so I filed for extension of 3 months but the website states that the usual processing times is 2.5 months .

    is it possible to get a result on my application within a month time?
    also how likely is an application to be accepted? I really need to be in US for months of oct-nov -dec hence cannot risk denial or reapplying for visa

    If i decide to leave on the last date on my I-94 can I reenter within 4-5 days ?? (I don want to miss the opportunity of continuing the clinical training and can only afford to take a few days off plus I want to attend interviews )

    will returning in such a short time create problems for me ?

    alternatively If I decide to wait a while say another 3-4 weeks beyond 30 sept but leave before I hear about the status of my application , what is the problem i could face at reentry??

    Also in the supporting documents I have included my I-94copy , return ticket , financial resources, letter from my hospital . Is there anything else that i can include ??

    I don't have a good answer for you. When you apply for an extension of a visitor's visa within three months of entry, the USCIS becomes suspicious that you intended the whole time to stay longer than three months. Also, to leave and to try to reenter under a new I-94 you would have to leave North America - not just make a day trip to Canada or Mexico - making it a much more expensive venture.

    If your program is through a medical school the college may have a counselor who assists students with immigration issues. In the alternative, I suggest consulting an immigration lawyer to try to get things right, with a minimum of risk.

    Hi,

    I have the exact same issue.

    I agree with what every forum says that if you just crossover to Canada, Mexico or caribbean and reenter, you will be given back the same i-94 and cannot get it renewed that way.

    However, what if you leave US by driving to Canada/Mexico/fly to Caribbean on the last day of the i-94, stay in Canada/Mexico/Caribbean for more than 48 hours and then drive back.

    Wouldnt you automatically get a new i-94 with a 3 or 6 month stay period since the old i-94 expired the day you entered Canada/Mexico/Caribbean? How can they give you back the same old i-94 if it is expired.


    Is there a rule where you need to be out of the country for a certain amount of time before reentering on a B1/B2 visa or something?
