    Unhappy Landlord's Options if There is No Lease

    My question involves landlord-tenant law in the State of: Illinois. I have a tenant who signed a 6 month lease that expired 8/08. She has continued to pay rent but this month she changed. She called me on the 13th to tell me she had been in the hospital and wld pay. On the 16th she brought me 1/2 the rent. I had already received a letter from the gas company informing me she was having the service cut off as of 8/15. So I'm under the assumptions she is leaving. I gave her a copy of the letter from the gas company. It is the 22nd she is still there but has not said anything about the gas or the rent. When I call she never answers. I'm fed up w/ the games. What are my options for evicting? I'm assuming she went from month to month to week to week am I wrong?

    It would be highly unusual for her to go week to week. Lease generally continue on a month to month basis unless either party informs the other that they are terminating the lease.

    You can begin the eviction process for non-payment of rent. You don't have to wait for her replies.

    Start with an Illinois 5 Day Notice to Pay Rent.

    If the original lease has expired, she is now month to month, unless the original lease stated that carryover would be week to week.

    She doesn't get to change it at will, it's usually spelled out in the original lease.

    You can initiate formal eviction proceedings now. Start here.
