    Default Small Estate - Death in 1983

    My question involves estate proceedings in the state of: California.

    The date of death was January 1983-The will was never probated. The real property value estimated by real estate agent to be less $30,000 at the time of death. I would like to submit a petition to the court under probate code 13150 for small estates but I don't know if that code was in effect in 1983. If it was, currrently the maximum amt is $100,000. What was the maximum in 1983?

    Also, the real estate agent checked the MLS service for sales in 1983 but the records only go back to 1996 so she did an analysis based on sales for that year and back-tracked to come up with a 1983 value. Is this acceptable?

    You're probating the estate now, under current law, not in 1983.
