    Default Can the Sheriff Force Me to Hand Over My Bike

    I had a repo guy come to my house this morning looking for a motorcycle i have. i told him he's not getting it and i dont have it, he then threatened to get the sheriff involved. After talking with him he left with out the bike, primarily because i dont keep it at my house, but left and wasnt in my face. my question is, can the police/sheriff force me to give my motorcycle up?

    The sheriff's office is the appropriate agency to enforce a court's order. However, without an order from the court, the sheriff's office will consider a repo situation to be a civil matter and will tell both parties so. Should they be summoned, their intervention will be limited to keeping the parties from getting into a confrontation or a physical altercation or going so far as disturbing the police. As far as the property being taken or not, it'll remain a civil matter and not their problem until a court has made it such.

    Laws are different in each state. In some states, hiding a vehicle from a repossession is a criminal offense.

    i live in massachusetts. i did read somewhere that it is a crime, but it didnt specify the states. i called the repo guy back to let him know what was going on and he said to me "well the thing is i dont know where the bike is and neither do they so give me a call again monday and ill let you know if they closed the repo case" so hopefully if they dont close it, he wont be searching for my bike.

    Massachusetts has a statute, MCL Chapter 266, Section 82, prohibiting fraudulent concealment of mortgaged personal property.

    You are not concealing anything unless you are asked for its location and provide a false answer. If you do not provide an answer, remain silent when asked, or not volunteer the location when not asked, you technically are not lying or violating the law as written. It is always best not to say anything to anyone.
