    Default Ending a Month to Month Lease

    My question involves landlord-tenant law in the State of: Minnesota

    Hello, I moved into a house with four other guys in December of last year. When I signed the contract I took the place of the person who lived in the room before I did. I gave my landlord two month written notice then moved out in May 2009. The landlord has not refuned me my security deposit and claims that my name is going to stay on the contract until someone moves in to take my place since Im the only person moving out and it was a "house" contract not an individual contract. Is there any legal way I can get my security depost back and my name off the lease?

    You signed a lease that has not yet expired? Then unless your landlord releases you, you're on the lease until it expires.

    Although it is true, you are technically on the lease, you can do a few things to help yourself along. When this situation occurs in my building, I have the new tenant (whoever is taking your place) write out his portion of the security deposit to the person that moved out (you) as well as signing a release saying you are no longer on the residential lease agreement.

    Although what the landlord is doing is a pain in the neck to you, he is not acting outside of his rights.

    You may want to consider passing the word to your friends that there is a vacancy and help fill that space.
