    Question Minor Name Change in Georgia

    My question involves name change laws in the State of: GEORGIA

    The Situation:
    When I was 17, I got pregnant by my boyfriend at the time. Four months into the pregnancy, he was arrested and sentenced to 10 yrs in state prison. We have since lost contact and I have raised my son with no help from him or his family. When my son was born I gave him my maiden (last) name and his father was obviously unable to sign the birth certificate. I recently married earlier this year to a wonderful man who has taken on the role as a father to my, now 4 yr old, son. I now share my husband's last name, while my son still has my maiden name .

    The Question:
    We are currently seeking the steps to give my son our last name. Also, my husband and I have our first baby on the way and would hate for my son to feel left out or any different for having my old maiden name. So, can we simply file a petition and if so, how? Would I need to contact this biological father who is in prison? Will my husband HAVE to legally adopt?

    Considering that the father hasn't been in your child's life, why doesn't your husband want to adopt?

    My husband would love to adopt! It's just the money issue as of right now. We were quoted thousands of dollars and with a new baby on the way on top of everything else... that's almost impossible. We were hoping there was another way around it. I'm assuming the answer is no???

    You will have to make contact with the child's father and serve him with a copy of the petition for name change. He will have the opportunity to legitimate the child and/or oppose the petition.
