    Default Is a fiance visa the right way to go?

    My boyfriend is a costa rican citizen. He has overstayed a visa and got caught crossing the mexican border before. He lived here on and off for 6 years-always working, going to school and NEVER did anything criminal except for the immigration issues. If I were to \marry him in Costa Rica, would it be recognized here? how long do u think it would be before he can come here? This is killing me. We both work a lot and want to resume school and start a family, but his stupid decisions are making it hard for us. What should we do??? He is in Canada right now on a work visa.

    Default Period of Exclusion

    Your fiance should be able to determine his period of exclusion, if he was not told when he was caught at the border, by inquiring with the USCIS or a U.S. consulate. The U.S. will recognize a marriage from Costa Rica or Canada, but it won't automatically overcome his problem from his prior illegal presence and/or deportation.

    Is there anyway around the time frame they give? What if I'm pregnant or come upon hard financial times?? I understand that it was his decisions, but it is fairly hard for people to become citizens legally.

    If you wish to try to devise a strategy around the exclusion, hardship to a wife and child can sometimes provide a basis. But don't get ahead of yourself - talk strategy with an immigration lawyer, as you could face some real hardship if such a strategy fails.

    I'm just trying to cover all of my bases because I don't want to end up in the situation of being alone under those circumstances. Thank you for the advice.
