Divorce final Jan 2008, ex got house but didn't have to refinance in her own name, so I know I am still financially liable and she has destroyed my credit. I just found out 2 weeks ago that she is 4 months behind on mortgage payment and has put the house up for sale.

I guess she has been moving all her stuff out over the last 4 days. So, she has abandoned the home and has defaulted on the divorce degree. Here is what the degree states:

Husband shall transfer to wife any and all interest in house but wife shall not be obligated to remove husbands name from mortgage or debtor on bond.

In the event that husband shall make any payments on the said loan, wife agrees to indemnify and save harmless husband from any loss, and in the event that he does make payments on loan, wife does hereby empower any attorney of any court to appear for wife and after one or more declarations filed, confess judgement against wife as of any term for any sum so paid with costs of suit and attorney's commission of 15% per cent for collection and release of all errors, and without stay of execution and inquisition and extension upon any levy on real estate is hereby waived, and condemnation agreed to and the exemption of personal property from levy and sale on any execution hereon, is hereby expressly waived and no benefit of exemption be claimed under and by virtue of any exemption law now in force or which may be hereafter passed.


Can someone explain this is English that I understand? I might make the payments that are behind and go to court to get her off of this house since she abandoned it and is in violation of the divorce degree. I know I can take her to civil court and get a judgement against her to get my money back, but I want to understand exactly what this decree states. Can anyone help?
