    Default Fired but Not Paid Yet

    State of California



    So on 8/08/09 I didn't show up to work on time and the owner of the company became very angry and fired me. Well I personally don't care because I work at another location with better pay and hours. As far from what I understood your exposed to be paid in full the day of your termination and I haven't gotten paid at all for the days I worked. It Is currently 8/19/09 and still haven't gotten paid till this day I call the owner of the company so I can return the uniform and collect my pay Check but he doesn't answer his phone. Either it will ring and go to voicemail or it will just go straight to voicamail I have left him multiple messages about the check but he hasn't made any effort to call me bak or anything. What can I do about this? Can I be compensated for all the days I haven't been paid for yet?

    First, return the uniform, paycheck or no.

    Next, file a claim for unpaid wages with the DLSE. Include the waiting time penalty and, if applicable, accrued vacation.

    do I legally have to turn the uniform into the owner of the company or van I just turn it intor the manager? The owner of the company said I have to turn it into him. If I have to turn the uniform into the owner i need to get a hold of him first. When has been unsucessful for a while now. Should I leave a voicmail stating that I will be filling a complaint with the DLSE

    If you turn it in to anyone but the owner (since he is the one pursuing its return), get a written receipt from the person you give it to, just to protect yourself. "Received from 'name' 1 uniform shirt, 1 pair uniform pants, clean, good condition", date, time and signed by that person . Something like that.

    You are not required to tell the employer you are filing a claim and, in this case, I wouldn't bother. You have already tried numerous times to contact the employer without results.
