My question involves labor and employment law for the state of: New Mexico
To start I will let you know that the FMLA is not offered at my place of work.
I work for a non-profit organization. About 2 weeks ago, I became ill and my boss asked me to go home and see a doctor. I called my doctor but he was unavailable to see me since he was out of town for 4 days. I finally saw him and he gave me a note releasing me back to work. I went back to work the next day and my boss sent me home again saying I didn't look good. I kept in touch with her and when I was feeling well again I called her (about a week later which is today) I went into work and she said I was still ill, she could tell by looking at me. She is correct, but I don't want to lose my job so I told her I would be willing to cut my hours so that I'm not overstressing myself. I really do believe I can work full time just fine. I mean, I have a doctor's note saying I can come back. Anyway, she said she wants me to resign and put me on call because they don't want to terminate me. She said in a month she will see if I she can bring me back on if I'm feeling better. I'm so confused I don't know what my legal options are. It seems that she is saying "resign and we will put you on call or don't resign and we will not put you on call and we will fire you". So, can she tell me I can't come to work even though I have a doctor's release? And, can she force me to resign and then switch me to on call?
