    Default Tape Recording a Minor

    I live in the state of Mississippi.

    Can you tape record conversations with a minor child (child is 7 yrs old) over the phone? Does at least one parent have to agree to the child being taped recorded?

    If you're not one of the child's parents, why would you be recording a child over the phone? This would be in relation to the child's phone conversation with you?

    Yes it would only be whenever the child and I have a conversation, no one else.

    Who are you? What's your agenda here? If you're not one of the child's parents, why would you be recording a child over the phone?

    I am the child's father. I would like to record the conversation because he has said things about his mother that I feel are a concern since she has full physical custody.

    If it is your telephone line and you are speaking with your child, then yes, you can record the conversations in my opinion. Your state has single party consent. Only the consent of one party is required, so you are in the clear.

    Even if you were in a two party consent state, I don't think the consent of the minor is needed anyway. A minor generally doesn't have the power to legally consent to anything.

    Because the recording is legal, it would also be admissible in a court of law. That is not to say the court might not keep it out due to relevance, objections of counsel, etc. If you do think it might ever be used in a court of law, keep a written log of each conversation, number the tapes, print date and times on all of them matching the log.

    I would only use the tapes as a last resort. Your kid will probably hate you if found out.
