    Default Illinois Threat by HOA to Change Locks for Being Late on HOA Dues

    My question involves a condominium located in the State of: illinois

    My association at foxfire condominium in Palatine Illinois has threatened that they are going to change my locks and lock me out for not paying my association dues last month and so far not this month either. My mortgage is also in foreclosure right now but I have at least been paying my hoa up until last month.
    When I returned to work after pregnancy leave I was laid off. And I have been laid off for 7 months and have a new baby. Been searching for a job to no avail. ... Can they really change my locks or do they have to place a lien and / or start their own foreclosure proceedings (whether judicial or non-judicial)?
    If they can change the locks do they have to give me notice in advance for so many days before?

    Their remedy for your not paying your dues would normally be a lien followed by foreclosure. You should also see what's in the condominium instruments, such as the agreement you entered into as owner and the association's bylaws. See 765 ILCS 605/9, 9.1, and 9.2 As your condo is already in foreclosure, they're apparently looking for another way to put pressure on you.

    Sure they can, but is it legal. IMO, I say no. They would have to go to court and get a judgment, then get in line behind the foreclosure. Plus it would not look good if you called the local TV station and did a report in front of their condos stating they they are locking out a new mom and infant.
