    Unhappy Filing a Stayover Without Name on Deed

    My question involves an eviction in the state of: MD but I live in FL.

    If tenants stay over 30 days I have to file at the court. My question is if I will face a problem filing and evicting if my name is not on the deed? My deceased parent's names are still on the deed of record. The executrix was told that in MD the will stands for the deed if filed with the register of wills. I was told this was excluded in the early 60's. I have the original deed, proof that I have pd the taxes and death certificates as well as the will. Will there be any issue with this? Also will the executrix or life estate recipient who abandoned the home 3 yrs ago and left me to pay for taxes and everything will have to file it or be contacted? They both live out of state. I'm just afraid that I won't be able to get these people out of the home because of the deed situation! Also is there an alternative to filing in person so I don't have to drive from Fl to file it? Thanks.

    whoa!! time out.

    if there is a life estate, that is the only person that has the right to rent the home until their life estate is extinguished, either through their death or some other legal means.

    as such, you cannot be the landlord and have no right to either rent the residence or evict a tenant.

    You have been giving the rent money to the life estate tenant, right? They are who is entitled to it, not you.
