    Default Green Card Issues and the Best Way to Get Citizenship

    I got green card for over a decade ago basing on special skilled labor category. During the interview for citizenship 5 years ago, I was asked to supply the proof of the employer who sponsored me about 15 ago for the Labor Cert and Green Card.

    However, I could not and did not provide the proof and I have not continued the application for citizenship since then. There are 2 reasons:
    1) I cannot provide the proof since I have been laid off from the employer who had sponsored me for Labor Certificate and Green Card application over a decade ago. So, theoretically, I should not be able to get the green card since I left the sponsoring employer a few months before my green card was approved, but somehow I was successfully granted the green card and I passed the Green Card interview many years ago.
    2) In addition, I cannot provide the proof since I am afraid that not only will I fail to get citizenship, but green card may also be removed.

    For the last 12-14 years, I keep working in US and paying taxes. I really want to be citizen. It is also worth indicating that my spouse is a citizen and we married for >10 years.

    So, what is the best and safe way for me to get my citizenship now? Would that be one of the following ways or other ways?
    - legally apply for giving up my current Green Card and use my spouse's citizenship to apply for my citizenship.
    - reapply for citizenship using my own green card and wait for a few more years so that statue of time limit will expire in case there are any wrong doings during the original green card application many years ago.

    What benefits do I lose by not being a citizen, and keep staying as Green Card holder forever?

    You should consult an immigration lawyer and get advice based upon the specific facts of your case. You have an unusual situation, and you want to do things in the best possible way.

    As long as you remain the valid holder of a Green Card, you're a legal permanent resident. The risk is in something happening that causes you to lose that status, such that you have to leave the U.S.

    What do you mean by use your spouse's citizenship to apply for yours? I dont think there is a such thing as that.

    The only way for you to apply for citizenship is to fill up the N-400 form and submit it to the USCIS office and follow whatever instructions they are giving you and make sure if you have had trouble with the law in the past, make sure all of those are served or paid.

    If you have submitted the N-400 already and USCIS sent you a notice regarding the evidence they need and you have not complied in the time frame that they had given you then your application will be considered abandoned.

    I think he meant that he would abandon his Green Card, then apply for adjustment of status based upon his marriage to his citizen spouse to try to get a new Green Card. It seems like a terribly convoluted, costly plan that could make things worse.

    I see. Well he can do that but I don't know how will he abandon his current status though and if ever he does it simply means deportation. Man, that's even more complicated.
