I got green card for over a decade ago basing on special skilled labor category. During the interview for citizenship 5 years ago, I was asked to supply the proof of the employer who sponsored me about 15 ago for the Labor Cert and Green Card.
However, I could not and did not provide the proof and I have not continued the application for citizenship since then. There are 2 reasons:
1) I cannot provide the proof since I have been laid off from the employer who had sponsored me for Labor Certificate and Green Card application over a decade ago. So, theoretically, I should not be able to get the green card since I left the sponsoring employer a few months before my green card was approved, but somehow I was successfully granted the green card and I passed the Green Card interview many years ago.
2) In addition, I cannot provide the proof since I am afraid that not only will I fail to get citizenship, but green card may also be removed.
For the last 12-14 years, I keep working in US and paying taxes. I really want to be citizen. It is also worth indicating that my spouse is a citizen and we married for >10 years.
So, what is the best and safe way for me to get my citizenship now? Would that be one of the following ways or other ways?
- legally apply for giving up my current Green Card and use my spouse's citizenship to apply for my citizenship.
- reapply for citizenship using my own green card and wait for a few more years so that statue of time limit will expire in case there are any wrong doings during the original green card application many years ago.
What benefits do I lose by not being a citizen, and keep staying as Green Card holder forever?
