    Question Re-Entry As a Visitor/Tourist

    Hello!

    I'll be as brief and accurate as possible! In my case I lived in the United States for almost 9 years. I arrived when I was 8 years old. My family applied to political asylum but it was denied and we wanted to appeal, but the lawyer that we had mislead my family and we couldn't take advantage of that appealing opportunity. We found out 2 months after (from the case's original date) that our case was denied and a removal letter was issued. But really there was no option left for us. If we went to immigration we would of gotten ourselves deported and going back to our country wansn't really the best option, so my family decided to stay in the US as we were (Illegal).

    Anyway, we were waiting for that so wished amnesty that was supposevely going to be passed I think it was 2007 at the time. But unfortunately it never took place, so we were getting desperate and where looking for options. We decided to move Canada after I graduated High School, thank God everything has been going good and we have a stable status. So here its where the question fits, I will soon receive my Permanent Resident Card and I wanted to Travel to the US for the Holidays. I would obviously have to apply for a Visa to travel. But would I be denied entrance though I was Never Deported ??? To add on, I don't have anything in my record. So, Please could anyone please give me a hand or some advice!!     You left when you were 17? You're now how old?

    By "never deported" you mean that, even though a deportation order was entered, your family left on its own initiative several years later?

    Yes Sir , I left When I was 17, I just turned 18 this summer.

    Yes, eventhough the order was there, we were never caught by immigration and we simply left the country on our own.

    Your having been the subject of a deportation order, and having left the U.S. so recently, works against you. I expect that your application for a visa will be denied absent your first securing an I-212 waiver; your age on departure may work in your favor, but I can't make any promises about what the USCIS will do.

    Hmmmmh ... I see , It's been 1 yr and 2 months since I've left the states ... Well, Is it possible for me to submit the I-212 waiver before asking for the Visa? or how does that work ?

    Excuse me ... I just checked the I-212 form and well it asks questions about being deported, Date of deportation, Place where the hearing for deportation was held and well I can't seriously respond/fill any of those questions ... because I never went through those processes of removal ... Can you please make this a little more clear, I appreciate it! thank you very much sir!
