    Default Caught Stealing

    My question involves criminal law for the state of: California. Hey guys my friends stole pizza from a pizza man and gave them their friends number. After they got away the pizza place called the number and arrested the person whose number belonged to them...Anyways, they (the stealers) didnt know this would happen and they knew the person that got arrested so they went to the pizza place and talked to the manager and paid for the pizza their friends had taken. When they paid for the pizza the manager told the kids that they were square and that the store does not want to press charges. My question is...Since the Pizza place did NOT want to press charges, can the cops still decide to and get them in trouble???? PLEASE HELP ME, IM ON END

    ultimately it is up to the prosecutors office to press charges but if the victim doesn't want to have the charges pressed, a DA is often not inclined to follow through with a prosecution but no promises. They can still be prosecuted if the DA wants to.

    Thanks for the info...One more thing. If the Pizza place tells the COPS not to, do you think they will press charges? What would you do if you were the kids?

    if a report was filed, the police will forward it to the prosecuting attorney for review. The PA will make their decision regardless what the pizza place wants but may take the pizza stores input into consideration.

    Oh, by the way, the pizza place is not the only victim. The pizza guy is the one who was robbed and that crime would be greater than stealing the pizza. So now, they also have the pizza guy to worry about as well.

    and if I were the kids? I wouldn;t have stolen a pizza to begin with but it is too late for that.

    other than that, I wouldn't speak to anybody about this and if the police want to question them, they should have a lawyer with them.
