My question involves a security deposit in the State of: Florida. I subleased this apartment for a few months but was required to put down a security deposit. At the time the landlord told me not to worry about filling out a condition report because the place is so old and he promised unless I punched holes in the walls he'd give me back the deposit. Well now he sent me a check for $39 out of the $300 with a list of all the deductions. The letter was not certified. The deductions include $120 cleaning fee, even though the next girl moved in as I was moving out and no cleaning was done in between, ditto for painting charges. I didn't take pictures like an idiot, but is the burden of proof on him or on me for showing condition of the place before and after I moved in? Also, since he didn't send a certified letter, can I just wait thirty days and then file for my full deposit because I didn't receive a certified notice?
