    Default Medical Collections in Georgia

    I just got a collection call regarding a bill from when my baby was born (August 2002). They had sent the bill in November 2005. The collections rep stated that the health insurance carrier (who hasn't been my carrier since 2004) made payments in December and then in January. I did call the insurance carrier to inquire about the bill, and they did pay (over $1800). Now the collections dept. wants me to pay the remaining balance $385. The rep stated that they received check number 302 in December in the amount of $25. I know I didn't make a payment, and neither did my husband, because I've been in bankruptcy since June 2005, and keep an account of EVERYTHING that comes in and goes out. Not to mention we've long since been past check 302. Under GA law, am I still obligated to pay?

    The statute of limitations on an open account appears to be four years; you can confirm that with a local lawyer. If that's the case, even without a novation from the supposed payment, the debt would still be collectable.
