    Default 16 Year Old Daughter Shoplifting in North Carolina

    My question involves criminal law for the state of: North Carolina
    I have a couple of questions. My daughter is 16 years old, is she still considered a minor in the state of North Carolina? My second question is, do they have diversion programs in the state of North Carolina. My daughter receive two tickets for shoplifting in two different stores. Wow! I am a very shocked and upset parent. What advice can you give me to make sure she doesn't have this on her record. And what should I expect in court?

    I'd be more concerned about what to do to make sure she does not do it again!

    You can get a Criminal Defense Lawyer, for starters. Many offer free consultations.

    You can expect to pay some money. The Civil Demand letters from the store will arrive, and be atleast $200 each.

    A public defender will be atleast $200-300.

    A diversion program or community service....whichever may be offered...there will be a fee to participate.

    The Civil Demand Letters you will receive from the store: Pay them asap. It looks good to the court. And...if you don't pay, it can affect YOUR credit rating.

    Since your kid has two charges: I recommend a lawyer. I also recommend making your kid seeing the cost of her crimes, to deter her in the future. Make her pay you back, or take away privileges.

    Of course my first concern is making sure she doesn't do it again! I don't have questions about that. She will be paying for all of this and she has had privileges taken away.

    You sound shocked that they would say that about making sure to not let her do it again. It is even more shocking to hear what you said because 95% of parents are to lazy to be parents and they are only concerned about getting their kids off the hook. Sounds like you have a good head on your shoulders. I would get a lawyer for sure because she is in hot water with two charges from two different stores. Also have a long hard talk with her and figure out "WHY" she did this. SHe will try to say , "I dont even know i just did it" But do not take that as an answer because she did it again after she was caught once. So there is a reason this happened. Is she being pressured by a bad crowd, is she mad at the world, does she have a real problem with this, etc. GOod luck

    It will be on her record for a while. I don't see where a judge is going to go very lenient on her. It may be expunged or sealed when she turns 18. It really depends on the judge and prosecutor, and what kind of sentence she is given.
