    Default Terminated 2-3 Weeks After Incident

    My question involves unemployment benefits for the state of: Wisconsin

    I worked in a warehouse, there was an incident involving my Powered Industrial Vehicle striking a coworkers vehicle while he was on the platform. The contact was accidental and little more than a tap. After the contact occurred I swore at the person I hit, asking him to move out of the way (which I regret). That day I was called into the Human Resources office where I gave a statement and I was told I would be called back in later that week. I continued working through the week and past the time HR said I would be asked to come back to the office. Twice more I was told I was going to be asked back to HR but I was never called back in. Approximately two to three weeks after the incident I gave a doctors note to my supervisor stating I had a 15lb weight restriction, at the end of that day my employment was terminated. The reason stated was "willfully running into someone's PIV to move it out of the way".

    Do I have a case?

    A case for what?

    Was this an injury sustained on the job? If so, was an incident report filed and was medical treatment sought?

    I do not believe the injury was sustained on the job, so the only way it factors in is that my regular duties involved heavy lifting and the slip from the doctor made that impossible. I received the note on the 4th of August and it's duration was from then until the 20th of August when I had another appointment with another doctor. I now think my termination is the result of my inability to fulfill my duties for an extended period of time rather than my incident with a coworker.

    The incident occurred on the 17th of July, I was terminated on the 7th of August (twenty two days later).

    A doctor's note need be given no weight by the employer unless FMLA is involved and in this case, that's unlikely. The employer is not therefore required to provide you with a light duty job. Can you reapply when you are given a full release?

    However, always file for unemployment. You don't ask, you don't get. When you complete the form asking for "why were you separated?", though, you tell them what the employer told you. I'm not trying to help you scam the system, but if you were fired for the reason they gave, you MAY get UI; if you were fired for inability to physically perform the job, your chances go down dramatically.

    I am not eligible for reemployment until 6 months after termination.
