    Question Getting Married Soon

    Hi...I'm a 27 year old from NY who finally decided to get married after all my friends have and everyone's happy. Only one problem, the love of my life had to be someone from another country. I've done a lot of travelling over the years for many reasons and the last one was because i got an opportunity to work in a hotel in central america 3 years ago. That's where i met her. I've been jumping back and forth from here to there to visit and keep this relationship going. Back in april i ask her to marry me and we read some legal books to see what was possible. She has a tourist B2 Visa and has visited the US before for vacation. Here's the prob: I plan on marrying her on Sept. 1st in NY when she comes to visit....actually 11 days after. And i read that it was fine as long as she returned to her home country afterwards...before her visa expires. She still in her last year of college so I figured that we'd get married and she'd go back and then i'd work on the adjustment of status during her last year of college cuz she wants to finish. Will we run into any serious problems? I've read a lot of stories on your forum but none close enough to mine to say ok lets continue or well lets back up. I would appreciate a straight forward response so i can either suck it up or continue with plans of my long distant marriage.

    ok i looked a little deeper and found a similar case to my own and this was the response:

    "If you are honest in relation to your intentions, there should not be a later problem. The question is less that you intend to marry in the U.S., than that you're entering on a non-immigrant visa and thus would be representing that you have no intention to try to seek permanent residency in relation to your entry on the B1.

    If they find out about the marriage, they may be suspicious of your intentions; I would not volunteer that information (although I would answer honestly if asked), and I would keep that return ticket handy
    . "

    My girlfriend is on a B2 visa and plans to leave....she has the return ticket and everything...I just want to know if we can get married and she can leave. I'm not worried about her returning immediately...i can visit...i just want to know if its fraud if we have proof of dating for the last 2 1/2 years and will i have difficulty requesting an adjustment of status for her.

    You'll marry, she'll return home, and then she'll try to come back... on a spouse visa? In a year or so when she finishes college in her nation of origin?

    If you want an absolute, iron-clad guarantee that this cannot and will not create a problem, that's beyond what anybody can give you. But if she makes no misrepresentations of her intentions to immigrate and abides by her visa, she can enter, get married and leave. There are places in the U.S. and around the world that are marriage destinations - they want tourists to go there, marry and leave. That of itself doesn't stand as an impediment to later immigration.
