Greetings!
I am looking to purchase a house on a large (50+ acre) lot in Maryland. A neighboring piece of property has a private driveway, of which 2000 feet of it is on this property, which extends completely across this 50+ acre lot, cutting the lot in two.
The issue is the way the private driveway cuts across the lot, the house is on the smaller part of the lot. If I were to purchase this lot and want to put in a decent sized backyard or pool, the lawn and pool would have to be on the other side of this private driveway. I would essentially be having a private driveway running through the middle of a backyard lawn. Or have to cross this gravel driveway to get to my pool.
The property deed of the lot with the private driveway is from 1975, one and a half pages in total length, and the only wording on the deed addressing this private driveway is "Grantors have right in and to the use of a private roadway extending from Main Street to land hereinabove conveyed."
Based on that wording, would I be able to get the private driveway property owner to move the driveway in order for me to make use of this large lot, or would it be better to just stay away from this property and look elsewhere?
