My question involves criminal law for the state of: California
I got an MIP last night at a friends party. I live in santa barbara and was at a friends party when I was issued the ticket. I was holding two unopened 12oz cans of coors light when the cop saw me. When the cops showed up we were behind a closed fencing and the cops walked right up to the fence (they could see inside the front yard due to the fencing not being that high) and asked for my ID. I felt that was not right since they weren't actually inside the house property. I did get a drunk in public back in november and did take the classes so I don't lose my license in a year (I got it reduced to an infraction aka public disturbance). I'll be 21 in 4 months so I really don't want to lose my license for a year. Is there any way I could fight it? Maybe if I claim I was moving the 2 cans of unopened beer onto the table or picking them up off the ground and setting them away from an open area? What would be the best way about going with this, I really can't afford to hire a lawyer or lose my license. Would I be able to retake the classes if convicted?
