    Question If the Defendant if Out of the Country and Not Able to Answer or Show Up in Court

    My mother has been filed with a Civil unlimited law suit, she has responded to the law suit with an answer to the court. The court date is in October 2009 and the plaintiff has sent "Form Interrogatories General DISC-001" asking for more answers within 30 days. My mother is currently out of the country and not available to answer to the questions or appear in court. What paperwork needs to be filed in court to notify them?

    I appreciate all your help.

    This case is in California...

    You don't need to appear in court to answer interrogatories.

    If she needs more time, and is afraid that the other side will seek sanctions for her failure to file timely answers, she needs to request more time from the party seeking discovery.

    But you can answer interrogatories from anywhere in the world.
