    Default Fence on Easement

    in Los Angeles, CA
    I share a driveway with a neighbor. easement is 15 ft per side down the property line. she put up a fence 5 ft from property line. she claims 5ft + my 15FT currently is wide enough for a car. can I make her move the fence back ?

    to her credit. it is sloped behind her fence, so she claim I have no use for the sloped land.

    only reason is because she is hassling me on another fencing issue, I want to use this as a leverage.

    separate question: how long can a fence be up ? before she claims it has been there forever that she no longer has to move it.

    You say that the easement gives you fifteen feet on her side of the property line. So you've told us that you have the right to use fifteen feet, not five feet. Given what you've told us, and that alone, it follows that she shouldn't have put her fence there.
