    Default Getting a Minor's Name Changed

    For the state of: Colorado
    Hey everybody, I'm am a minor and my father is petitioning for my name change, but i have a few questions about it:

    My parents are divorced but have equal custody and visitations is just based on whoever i feel like being with, from what I understand from the minor name change documents, to get a minor's name changed somebody petitions the name change, it gets filed, and then there is a hearing for the name change. For the hearing you have the option to send a consent form to the other parent to agree to the name change, or 1. you just send a notice for the hearing or 2. if they dont sign it then they go to the court hearing to state their objection. So, in this situation, if my mother ignores the consent and goes to the hearing to object, does it become like a court case type thing where both sides have their arguments and the judge would decide the winning side?

    Also, I have seen options like a lawyer representative for petitioning so is it also possible to have somebody who isn't my guardian petition the name change?

    And lastly, if the court hearing for my name change results to my name not being changed simply because my mom objects to it, is there any legal way to fight that objection? Ever sense I have moved to Colorado (summer '08) I have been going by this name that I'm trying to have changed to, I use my legal name as little as possible and almost everyone I know in Colorado doesn't know my real name so besides the fact that I dont like my legal name and like what I have been going by, this would be the main argument to have it changed.

    Start by reading all of the forms here.

    Sort of. It's not going to be like Law & Order or any such thing. The judge will ask why she objects, and she'll have to do better than "Because I object!" Then you'll be asked why you want your name changed, and you'll be expected to lay out clear reasons - you aren't called by your legal name, you've been using your current alias for X years, and that's what everyone knows you as, you are unhappy with your legal name for X reasons.

    USUALLY, as long as clear reasons are presented and the judge is convinced that the change of name is not for fraudulent purposes, the change of name will be granted.

    If it isn't granted, you're stuck with your legal name until you turn 18, at which time you can petition for yourself, and your mother's objections would be given very little consideration.

    Ok so technically am I allowed to have anybody petition my name change? Because in the forms I've seen fill out boxes for the petitioner to fill out whether they are a guardian, not a guardian, family member, etc.....also because my dad was willing to petition my name as long as my mom just gave in and signed the consent but sense that doesnt look like its gonna happen I might have to look for another petitioner...
