    Default Defamation by Supervisor - What Are My Rights

    My supervisor wrote libelous, false statements about me on paper and approached me with these items in a counseling session. She implied on two occasions and in front of our HR director that these statements came from the President of the company. I have since met with the Pres and she was completely unaware that this written document existed, as was HR, and that she made none of these statements and apologized to me. My supervisor lied to our HR director and said that she could not destroy this paper without clearing it through the President first, again with the HR director and myself knowing that these are false statements and that they never came from the President. I have recieved almost perfect performance evaluations from my supervisor since i've worked here and have never been counseled or warned about any issue. I have numerous credible witness in suport of me and written proof that my supervisor has expressed this retaliative behavior to others in the past. I believe she is retaliating against me for a personal falling out. If my supervisor were to be replaced tomorrow and a new supervisor read this document who knows what they would think of me. I can prove that her allegations are not true and she cannot prove that they are true. I love my job but she cannot be allowed to get away with this and HR is dragging their feet although they know how dangerous these statements are. What should I do?

    There are a very few states where an employee has the right under the law to put a rebuttal into his personal file if there is something with which he does not agree. Ohio, however, is not one of these states.

    At this point, since you have suffered no damages and since Ohio does not have the law I referred to, there is nothing for you to do. If, at some point, you should suffer some form of damages that you can directly relate to this issue, you can revisit the situation again. However, it is unlikely that a single document by a single individual will outweigh a good record of performance appraisals and no writeups. I suspect that you are giving far more weight to this document than it deserves.

    I dont know what the definition of damages are but I have suffered loss of sleep and definite signs of depression since this occured. For three months I have had to come to work believing that the President thought this of me until I found out the remarks were never made from her and were not true. I work for a college and my supervisor wrote that I am "too familiar with male students and give them the wrong impression" and that (verbatim) that I socialize off campus with students with alcohol involved. Neither of which are true and can be proven not to be true and again, she cannot prove them to be true. Those two statements are my biggest concerns, but the whole document is incorrect and I have proof in writing. I may be giving far more weight to this document than it deserves but those are some pretty heavy accusations.

    My answer stands. Until you are fired, demoted, or in some other way treated adversely at work in a way that you can directly tie to this document, you have no damages as the law sees them.

    BTW, "too familiar with male students and give them the wrong impression" is an opinion and is not actionable.
