    Default Separation in Pennsylvania

    I am in the military, and have been seperated for almost three years and filed for divorce(no - fault) over 13 months ago, can i get a divorce now , and what has to be done , court or motion wise? My attorney was trying to tell me i had to wait two years from filing , but everything I read , the clock starts at seperation , and she has brought up june of 2003 as being the date i left. thanks jonw

    Default Pennsylvania No Fault Divorce

    Your spouse won't consent to the divorce?

    It is my understanding that for a no fault divorce based upon separation, the date you filed for divorce is presumed to be the separation date unless the court finds that the facts justify using an earlier date. I am not clear on whether your lawyer is stating that to be incorrect, or if he is instead suggesting that your facts won't inspire the court to use an earlier date.

    my attorney has used the date i moved out as the separation date in my filing for divorce ( oct 2004) ,
    i finally did the divorce filing in feb 2006, so hopefully the 2 yr thing works and all will be done in october .
    i'm wondering if Pa divorce laws require me to pay for my wifes health insurance up to , and after the divorce is final ?? any idea who might know about this ?

    Your lawyer should be able to tell you what is required by your state and under existing court orders. You should definitely consult your lawyer before making any decision to end your wife's health benefits. Up here in Michigan, I helped a woman recover a great deal of money (well into the five figure range) from her ex- due to medical bills she incurred after he cut off her health benefits without notice to her, and in violation of a court order.
