    Default Pretending to Pull a Rope Across a Road

    This is purely hypothetical:

    So I was sitting at my house with my roommate in my neighborhood, sitting in my living room watching T.V. and I heard this motorcycle come by, louder than hell. I ran outside just in time to catch him speeding by at what appeared AT LEAST 70 on this residential street. I tell my roommate that next time we hear him we should go act like mimes and pull an imaginary rope across the street so that he will think it's real and maybe slow down.

    Of course, 30 minutes later he comes by doing 70 again. We pull this imaginary rope across the street and it happens. He slows down...

    However, he touches his front brake too hard and flips over his handlebars, breaking both legs and an arm. He also has road rash pretty bad.

    While this is completely hypothetical, it is a real debate that my friend and I fought over. We both have no legal experience...just curious as to what would happen if we really did do this to that annoying motorcycle rider.

    The question is, who would be at fault? The motorcycle rider speeding in the neighborhood or the kids playing a joke with an imaginary rope who try to get him to slow down?

    He sees the prank, stops, get off his bike and gives you a beat down. Just as plausible as your scenario.

    You and your idiot friend would likely be charged with reckless endangerment.

    If there's anything left of you after the cyclist gets through with you - though I'm not sure about the utility of charging the smoldering remains of a single flaming sock.

    What logical person would give someone "a beat down" for that? I mean come on...your comment is useless.

    Why are we idiots? Did we do this? No... I'm sorry that I deluded your intelligence.

    Again, why the hell would a punk motor cycle rider be so inclined to physically take on two fit guys in their twenties for playing a joke on him? It makes no sense. Y'all are being irrational as far as the "beat down" scenario goes. In fact, I would really like to see that. I'm pretty sure if a motorcyclist tried anything when he was outnumbered, he would probablly get beat...not the other way around.

    Doing something you know could cause somebody else to be severely injured or killed? And your knowledge - expectation - that injury would result is part of your scenario. It's perfectly reasonable to say that such an act would be "stupid".

    Well, it seems you have no clue about the reaction achieved by endangering someone's life. The biker would not be coming over to you after crashing his bike to have a good laugh and go out for beers. He would beat you ass, as that is where your brain appears to be stored. Even if his arms were broken, his buds would take of you.

    I'll reiterate: I'm not very worried about an ass beating from one person. Why do motorcyclists get a reputation for being such badasses? Stupid stereotype if you ask me. I think that someone who drives a car/truck might have this magical ass beating ability too... Do you see what I'm getting at? These ass beating scenarios that keep being brought up just add no good advice or help to the answer of the question that I asked.

    No, you and your friend would not be idiots, although there is/are better ways to handle it. 70 on a residential street is a "safety" issue for all who live and walk and travel on it.

    If you did it and he was hurt due to a sudden stop, he is also at fault. His being hurt would be the "proximate/direct cause" of your action, even a faked one.

    The crux of the legality would hinge on "when" and "why" it was done.

    Something similar, not hypothetical, actually happened to someone I know at work. Some motorcyclist neighbor would come back home, speeding down the street on a noisy motorcycle as 3:00AM every night waking up the whole neighborhood. The police was constantly called, but told everyone the guy didn't violate any laws.

    So my frined thought of calling his councilman, and sfter listening to the problem, it was decided a noise ordinance was needed, which this guy would violate. My friend then said "that's good, but is the police going to do anything with this ordinance"?? The answer was "of course, I'll tell the mayor to have the police station a squad car on your street".

    From what I'm told, that took care of the problem.

    What my friend did was legal, using the system. What you plan to do is not.
