    Exclamation Quick Deferral

    My question involves a speeding ticket from the State of: Lynwood, WA.

    I got pulled over going 38 in a 25. I was wondering if i could use my deferral because I have had a speeding ticket within 7 years but never used it. On the pamphlet the officer gave me it states that "you have had no moving violations in the last seven years" to qualify for a deferral. I have had a ticket when i first became a driver and I didn't use my deferral but instead just paid the ticket price. Am i not eligible for a deferral now because I didn't use it earlier?

    The law states:

    Quote Quoting RCW 46.63.070 (5)(b)
    A person may not receive more than one deferral within a seven-year period for traffic infractions for moving violations and more than one deferral within a seven-year period for traffic infractions for nonmoving violations.

    So, according to the law, as long as you have not received a DEFERRAL within the past seven years, you should be eligible. But, remember, a deferral is ALWAYS at the judge's discretion.
