    Default Can You Re-File a Ch. 13 After Dismissal

    My question involves bankruptcy in the state of: WI

    I originally filed a Ch. 13 in 2006. In the spring of 2008 I lost my job and moved. My CH 13. was dismissed. I have been employed since early last Summer. Am I able to re-apply for Ch. 13?

    Generally, yes, you are able to file a new Chapter 13 after a dismissal of a previous one.

    You might want to talk to a bankruptcy attorney. Whenever you do file more than one Chapter 13, courts do look at all circumstances carefully to be sure the second case isn't filed in bad faith.
