    Default Emancipation at 17 in Florida

    My question involves emancipation laws for the State of: Florida

    I am 17 years old and need to get emancipated from my dad. I've already read up on this a bit and know now that it would take a parent filing for my emancipation for it to have a chance. My question is: If I lived under my mother's custody for 15 years and am currently living under my father's custody would my father still be the only person that can file for emancipation? I would also like to point out that it has been made clear in court that I am only living with my dad to be able to go to school here in America while my mother has been living in Puerto Rico for 2 years. For 1 of the 2 years I have been with my dad he had temporary custody and just recently filed for full custody because of child support issues. Recently, my stepmother has decided to move out and mental, and physical abuse can be expected from my father when she leaves. Would all of this make it at all possible for me to be emancipated from my father with my mother's consent if my stepmother would be willing to take me in and I would get a part-time job?

    A part time job while living with your stepmother will NOT satisfy the self-support requirement of emancipation. Emancipation does not mean that you live with someone other than your parents/custodial parent; it means that YOU pay for your rent, food, clothing, utilities, medical care, transportation, insurance, school fees and supplies, etc. etc. etc., and that you do so alone and unassisted.

    So no, it would not be possible for you to be emancipated under the conditions you describe.

    The key to any emancipation is that when seeking to be emancipated FROM someone....that means there IS someone. A someone that you might hate with every fiber of your being, but STILL a someone who puts a roof over your head, clothes on your body, and food in your stomach. Emancipation is about NOT having someone who does that, thus FORCING you to have to do it for yourself. Emancipation is about showing a court that you NEED it, NOT how bad you WANT it.

    Puerto Rico is America, it is not a foreign country.

    Since your Father is the custodial parent, he is the one who would file for emancipation. When a noncustodial parent is willing to file for a child to be emancipated, it usually means that the noncustodial parent's motivation is wanting to no longer pay child support.

    You are not self supporting, so you are not a candidate for emancipation.

    Since you are 17, by the time you ARE self supporting and can file, you will likely be an adult anyway.
