Here's my simple question, how are they planning to go to court with no witness? An officer in court is a witness only, supported by case law. If anyone shows up to give testimony that the picture is accurate or whatnot then you need to motion to the judge to not allow them to present testimony. You asked for discovery and you recieved a response that there would be "NONE" for witnesses; therefore not realizing someone other than the prosecutor would be present you were unable to provide a fair and reasonable defense.
This could backfire and you might just get a two week extension on your trial so you can "prepare" for the witness. But if it puts you over 45 days and you didn't waive your speedy trial rights you can get it dismissed on that.
