    Default Filing Chapter 7 Bankruptcy Twice

    My question involves bankruptcy in the state of: Missouri


    We went to court for chapter 7 bankruptcy in July 2002. It was discharged, but I am not sure of the exact date.
    Since then, my husband has lost several jobs and we have taken out personal loans, credit cards, and even payday loans to try and make ends meet. We even sold our house in an attempt to use the equity to pay off these bills. Last year my husband had an automobile accident that left us several thousand dollars more in debt. The past year we have struggled non stop and are behind on several payments. To make a long story shorter, we think that filing bankruptcy again is our only option. I am afraid that we won't be able to file since it has been barely 7 years since we went to court. I am also afraid that the payday loans will be a problem as well as the personal loan that holds the title to our only automobile.
    We have 5 children and a mountain of debt, so any help would be greatly appreciated!!

    If you filed a Chapter 7 and received a discharge, you must wait eight years from the date of the first filing before you can file a 2nd Chapter 7.

    If you filed a Chapter 7 and received a discharge, you must wait four years before you can file a Chapter 13 and be eligible for a discharge

    Unfortunately you must wait 8 years in order to file Chapter 7.
    and Obviously you cant go on Chapter 13

    My own suggestion is to wait till you can.. However Do not consolidate your bills no matter what if you intend to file Bankruptcy as soon as you can.

    You can probably try first on minimizing your expenses.
    and second gather your expenses and any incoming money and start communicating with your creditors to settle a lower payment due to your financial hardship.
    Im sorry to hear that you are in deep debts. We cant help it sometimes.
