    Default Burst Water Pipe on Easement in Washington State

    Recently, a large, underground irrigation pipe located on an easement on my property burst. It flooded my backyard and has more than likely compromised the integrity of my retaining wall. Hundreds, if not thousands, of gallons of water released into my backyard before the pump was shut off. This irrigation pipe brings water to a group of homes located well away from my property.

    A construction company was out to fix it today. Their opinion is that the pipe burst at a joint about 10 feet underground. This was either due to too much water pressure, an old pipe or a combination of both.

    My question is what are the liabilities involved with something like this? Who is responsible for the repairs and if damage was done to my yard and retaining wall, is it possible to be compensated?

    The pipe brings irrigation water to a group of houses a couple of hundred yards away from my house. These houses are not within my development. These houses have the easement for the water rights, so I would assume they are the owners of the pipe.

    Did you get the name of the construction company. Ask them who is paying them.
