My question involves paternity law for the State of: NEW YORK
I am writing this for a friend. He establish paternity at the age of 18 alone and not knowing when the case went to court for child support. Signed the birth certificate. Father (1) always felt that the child was not his and never established a relationship with the kid nor did the mother push the kid to the father to establish a relationship but kid carrys his last name, and he pays his child support. Kid starts establishing relationship with the "Other" father's (2)family not the father father (Do I make sense I hope so) and family members accept him as there own. Mother decides to tell the "Father" (1) this child may not be yours. They agree for a paternity test...what does this mean for the Father Will court agree for a paternity test even with Mother agreeing to it also??? What happens if child is not his...does he continue paying child support??? Should mother go put in petition or alleged father??? Need advice..thanks to all that respond
