    Unhappy $6 Shoplifting Being Charged for Burglary in the Second Degree

    My question involves criminal law for the state of: California

    My boyfriend was arrested today for stealing two energy drinks that equaled out to the amount of $6 and instead of being charged with Petty theft he is being charged with 2nd Degree Burglary.

    My question is how long will he most likely get? This is his first arrest he has no prior convictions, he is 20 years old. I don't understand why it is not being charged as Petty theft, I thought if its under $400 its considered Petty theft? He stole from a grocery store, when he got out and realized he was caught he sat the drinks down outside the stores front entrance and took off running and two citizens caught him down the street and then the grocery store employee's caught up to them.

    His bail is set at $15,000 I'm wondering if there is a chance that it can get lowered or that the charges can change. Will he be able to be let out of jail while awaiting trial?

    I understand he did something wrong but I feel like he shouldn't be getting Burglary. I'm confused about the whole situation so if anyone could please help me understand, thank you so much.

    Burglary has and can be depending on the city/county be charged for using a device to help you steal(pillers, etc) fighting outside with store security instead of just coming back in, or running from them. To bad he took off and ran.
