My question involves a traffic ticket from the state of: California
First off, thank you so much for all the free advice on this site. I’ve learned so much just from browsing these forums!
Now on to the nitty-gritty: I allegedly rolled through a right-turn at a red light in Emeryville (Alameda County), and got popped by a traffic camera. I did a written trial by declaration and cited both the 15-day defense (CVC 40518)and the speed trap law (CVC 40801). I’m not sure if the speed trap law applies to running a red light, but I threw it in there anyways based on advice from another website. The verdict came back guilty, so I’m gearing up for my big Trial De Novo now.
So some questions I have:
1. The court sent me a pre-filled TR-220. Do I just write in my violation (VC21453A) and mail it in (certified)? Then they will send me a trial date and I have to go in in person? Is that how it works?
2. I just read about Discovery. Is it too late for me to request all that documentation from the prosecutor? It would be awesome if they didn’t produce it and I could get the case thrown out.
3. If all else fails, I’ll give the defense outlined here a try, and hope no one shows up. (It looks like the ticket was issued by an out-of-state company.) Anything else I should know?
