    Default Confidential Drug Screening Results

    Ok, quick question that I'm sure has a quick answer...

    Can a company administer a pre-employment drug screeing test on a large group of people in one room with everyone's consent form(SSN Info) and test results on the tables in front them for everyone in the room to look at?

    I wasn't there to see what happened, and you did a poor job of explaining yourself.

    Are you stating that you put your name and SSN down on a sign-in sheet, along with other job applicants, without raising any objection to your employer. And now you want to know what? If your employer would have had to accommodate you had you objected? Or are you an employer wondering if you need to be more protective of applicants' information?

    I was one of the candidates in the room (and yes I passed, no reason not to). We were all asked to fill out a "Custody & Control Form" that contained our name and SSN. Then it was placed on the table in front of us. They then proceeded to give us a mouth swab which we placed in our mouths. While we were sitting with these swabs in our mouths they passed out the disposable testing unit. The unit was a plastic base that we placed the swab in and it slowly displayed the results of about 6 different drugs. Keep in mind there are about 30 of us in the room so we are able to watch each others results as they appeared on the strips located on the testing base. We are also able to see everyone’s’ name & SSN clearly on all the forms that are still located on the table in front of us. There was one guy who switched his test base with someone else’s because he failed his, and they had to retest both the guy who failed & the one he switched with...a bit of an embarrassing moment for the guy who was clean!

    ...my question is did they violate my HIPAA rights by making my test results visible for everyone to see?

    Is a pre-employment drug screening considered Personal Health Information (PHI)?
